Pet Bylaws - Reminder Notice

We hope this letter finds you well. Due to recent complaints from residents regarding items being placed or installed on balconies and the requirements regarding pets, the Strata Company and the Council of Owners of Vantage Apartments wish to address these concerns. We have become aware that some residents may, knowingly or unknowingly, be breaching these bylaws and we wish to remind residents of the specific wording of these bylaws and their personal obligations in relation to them.

BALCONIES

The bylaw relating to balconies is as follows:

20. BALCONIES

(1) The external appearance of the building must be maintained to a uniform appearance.

(2) A proprietor, occupier or other resident of a lot shall not do any of the following without the prior written consent of the strata company.

(a) Enclose or add blinds, awnings, or other materials to the balcony or terrace of a lot.

(b) place or keep pot plants or planter boxes on the balcony or terrace. (c) install a gas bayonet on a balcony or terrace

(d) install a barbeque or other cooking device on the balcony or terrace. Or (e) install or affix any structure (including shade sails), improvements, or objects to the balcony, terrace, or any external walls or surfaces of the building.

We have received a complaint about unauthorised structures built and attached by owners to balcony balustrades of individual lots that breach the bylaws of the strata company.

If you are currently breaching this bylaw, you have the following options:

Remove the items:

Take down or remove any items that breach the bylaw from your balcony or terrace.

Apply for consent:

Submit an application to the Strata Company to seek written approval for the items in question.

Please note that while some items may be approved at the discretion of the Council of Owners, others may require an inspection by a building engineer (at your cost) and/or require referral to a General Meeting of the Strata Company for approval.

The Council will review each application individually, and any items needing approval outside of the Council of Owners authority will be referred to a General Meeting for consideration once the resident has completed the appropriate application.

PETS

The bylaw relating pets’ states as follows:

15. PETS

(1) A proprietor, occupier or other resident of a Residential Lot may keep, without the consent of the strata company:

(a) fish in an enclosed aquarium;

(b) one caged bird;

(c) one Small Dog; and (d) one cat, (each a Pet).

(2) A proprietor, occupier or other resident of a Residential Lot must obtain the prior written consent of the strata company before that proprietor or occupier keeps:

(a) more than one Pet; or (b) any other animal

(3) A proprietor, occupier or other resident may only enter upon the common property with a Pet for the purpose of access to, and egress from, their lot.

(4) The owner of any animal that defecates or urinates on common property shall promptly clean up the mess and disinfect the affected area.

(5) The strata company may serve notice on a proprietor, occupier or other resident of a lot who's pet consistently makes a noise that can be heard outside of the lot or causes a nuisance to other proprietors requiring the proprietor to remove the offending pet from the parcel within 7 days of service of the notice.

Please note the requirement to obtain written consent from the Strata Company before bringing any non-compliant pets into your property.

We have received complaints about the size of certain dogs and following investigation have found that there are a number of pets at Vantage, which clearly fall outside the requirements or number limits of clauses 15 (1) and (2) for which a written consent has not been sought or granted.

If you are currently breaching this bylaw, you should immediately:

Apply for consent:

Submit a pet application to the Strata Company to seek written approval for your non-compliant pets.

The Council will review each application individually and seek further legal advice if necessary.

We appreciate your attention to both of these matters and your cooperation to ensure that you comply with the bylaws to ensure we are maintaining the integrity of our community.

If your unit is tenanted, please ensure a copy of this notice is forwarded to the Tenant/Agent.
