Update on Building Defects Claim

We would like to provide residents with an update regarding the ongoing Building Defects Claim.

The Building & Energy Inspector has completed their review and determined that the estimated cost to remedy the identified issues may exceed $100,000. As a result, the Building Commissioner does not have jurisdiction to issue Building Remedy Orders for matters above this amount.

Accordingly, the Inspector has advised that the matter will likely be referred to the State Administrative Tribunal (SAT) for further consideration.

We will provide a further update to all residents once the Building Commissioner’s Delegate has made a final decision on the next steps.

Dear Residents,

We would like to provide an update on the ongoing building defect rectification process.

As many of you are aware, this has been a complex and, at times, frustrating journey. While we are conscious of the financial impact, it’s important that we continue to allocate funds to properly investigate and address these issues. If not managed thoroughly, there is a risk that unresolved defects could result in significantly higher costs down the track.

We have now lodged our defects claim with the LGIRS (WA Department of Local Government, Industry Regulation and Safety – Building & Energy Division) and are currently awaiting their response. In the meantime, we will continue to seek the appropriate legal and technical advice as required.

If any owners have relevant expertise that could assist the Council of Owners in assessing potential rectification costs, we would greatly appreciate your support and it may help reduce the expense for all owners. We are committed to ensuring that any works undertaken are both necessary and cost-effective.

Dear Residents,

We wish to inform you that, in accordance with standard practice for new buildings in WA, a formal Complaints Schedule has been submitted to BGC ahead of the six year deadline, detailing a number of identified building defects and issues requiring remediation.

This action forms part of our commitment to ensuring that all matters affecting the integrity, safety, and livability of the building are appropriately addressed with the relevant parties.

At this stage, the submission has been acknowledged by BGC, and we are awaiting further response and action. We will continue to keep residents informed as the matter progresses.
